This policy describes how Greater Than Inc. ("Company", "we", "our", or "us") collects and processes personal information about you when you visit our site www.drinkgt.com (“Site”) and make purchases from our Site.  This policy also describes what we do with the information we collect.

This policy applies only to information we collect:

  • Through the Site.
  • In communications, including email, text, chat, and other electronic messages, between you and the Site.
  • When you interact with our advertising and applications (including mobile apps) on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Company or any third party that does not link to this policy; or
  • Any third party, including through any application or content (including advertising), that may link to or be accessible from or through the Site.

The Personal Information That We Collect or Process

"Personal information" is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information.

We collect information about you when you purchase something from our Site or interact with our Site, such as when you create or update an account, place an order, subscribe, make a request, participate in rewards programs, surveys, sweepstakes, contests, or promotions, or create, upload, or post content to the Site, including reviews, media such as photos, videos, or audio recordings.

Automatically Through Our Site

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect information that may include some personal information. When you interact with the Site, there are third parties that may use automatic collection technologies to collect information about your or your device. These third parties include:

  • Advertisers, ad networks, and ad servers.

  • Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, platforms, and other online services. From Business Partners and Service Providers

We also may receive personal information from business partners that we engage to share consumer information with us, including your personal preferences and demographic information such as age, gender, and income level so that we can better provide you with a personalized experience, including personalized offers and services.

  • Text marketing: With your permission, we may send text messages about our Site, new products, and other updates. Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system.

Who We Disclose Your Information To

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may also disclose personal information that we collect or you provide as described in this privacy policy:

  • To contractors, service providers, fulfillment and shipping providers, e-commerce platform provider, payment processors, and other third parties we use to support our organization.  
  • To a buyer or other successor in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use, Terms of Sale, and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

Additional Information on Third-Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.  Once you leave our store’s Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms of Use.

 

SHOPIFY

Our Site store is hosted on Shopify Inc.  Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

 

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Consent

How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.  If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

Your Rights and Choices About Your Information

This section describes mechanisms you can use to control certain uses and disclosures of your information.  Cookies, and other tracking technologies choices:

Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some Site features may be inaccessible or not function properly. Some browsers include a "Do Not Track" (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
Location Data Choices. You can choose whether or not to allow the Site to collect and information about your device's location through the device's privacy settings. Disabling location services may impact the Site’s features or functions.

Personal Data Transfer Consent

We are based in the Commonwealth of Kentucky in the United States. We process, store, and transfer the personal information we collect, in and to the United States.  If you are outside of the United States, the laws and privacy protections in the United States may or may not be as comprehensive as the laws of your home country.  By using or engaging with this Site, and if you submit your personal information to us for a purchase, registration, or otherwise through the Site, you consent to this transfer, storing, and processing outside of your home country.

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal information, including:

Access and Data Portability. You may confirm whether we process your personal information and access a copy of the personal information we process. Nevada Residents

Nevada provides its residents with a limited right to opt out of certain personal information sales. Nevada residents who wish to exercise their sale opt-out rights may submit a request to a website operator. However, please know we do not sell personal information that would trigger the Nevada statute's opt-out provisions.

 

How We Protect Your Personal information

To protect your personal information, we take reasonable precautions and follow industry best practices designed to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  If you use a credit card for purchases, it is processed by our payment processor and the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, our Site is powered by Shopify and follows PCI-DSS requirements for payment card processing.  However, we cannot guarantee the security of your personal information transmitted to, through, using, or in connection with the Site and any transmission of personal information is at your own risk. The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal information against unauthorized use, disclosure, and access.

How We Retain Your Personal information

We keep the categories of personal information described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Site, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal information. At the end of the retention period, personal information will be deleted, destroyed, or deidentified.

Age of Consent

By using this site, you represent that you are at least the age of majority in your state of residence.

Children's and Minors' Data

Our Site is not intended for, and we do not knowingly collect any personal information from, children under the age of 18. If we learn we have collected or received personal information from a child under 18 years old without verification of parental consent, we will delete that information.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
